A judge has ruled it was unreasonable for the federal government to use the Emergencies Act to bring the “Freedom Convoy” in Ottawa and at key border crossings to an end in 2022.
Federal Court Justice Richard Mosley said the use of the act led to the infringement of constitutional rights.
The Canadian Civil Liberties Association and several other groups had argued in court that Ottawa used the emergency measures without sound statutory grounds, while the Public Order Emergency Commission found the government met ‘very high’ legal standards for using the law.
Deputy Prime Minister Chrystia Freeland has said the government respectfully disagrees with the ruling, and will appeal it.
